The settlement of four class actions against Seiko Epson Corporation, Epson America Inc. and Epson Canada Ltd. has been finalized.
Consumers in Canada had brought four class actions against Seiko Epson Corporation, Epson America Inc. and Epson Canada Limited alleging that Epson inkjet printers would prematurely indicate that ink cartridges were empty, thus allegedly depriving the class members from fully benefiting from the Epson inkjet cartridges they purchased.
Epson denies any wrongdoing or liability and the settlement is a compromise of disputed claims. This settlement, which has been reached without any admission of liability by Epson, is made on behalf of all consumers of Epson inkjet cartridges in the four related regions of Canada for qualifying printers.
The four class actions are:
Grégoire v. Epson Canada Limitée in the Superior Court of Quebec,
Jeffrey v. Epson Canada Limited in the Ontario Superior Court of Justice,
Douglas Ernest Smith vs. Epson Canada Limited in the Supreme Court of British Columbia, and Michael Herda vs. Epson Canada Limited in the Manitoba Court of Queen’s Bench. Each of these courts has issued Judgments approving the settlement.
The settlement provides that all individual members of the class may receive one of the following benefits for each Epson inkjet printer specifically identified in the settlement, and purchased between November 1, 2002 and September 1, 2006:
– a $45 credit in the form of an E-Store code, which would be valid for twelve months,
– the sum of $20, payable by cheque, and a $20 credit in the form of an E-Store code, or
– a one-time 25% E-Store discount to a maximum value of $100.
