Asia Pacific Microsystems and MicroJet Technology Co. have been noted as infringers.
HP has announced a favourable review from the US International Trade Commission regarding the importation and sale of patent-infringing inkjet cartridges, following an Initial Determination from June 2011.
The ITC has specified Asia Pacific Microsystems (APM), a subsidiary of Taiwan-based United Microelectronics Corporation, as a contributory infringer regarding HP patents in manufacturing inkjet printheads. The ITC has also determined that APM was “liable for inducing infringement by other companies in supplying inkjet printheads”.
MicroJet Technology Co., a subsidiary of Taiwan-based DB-Tel Incorporated, and PTC Holdings Limited have been named direct infringers relating to HP’s patents in the “manufacturing and/ or sale of inkjet print cartridges”.
The ITC has recommended a General Exclusion Order as the most appropriate action. As such, US Customs Service is due to exclude all infringing articles without regard to source.
