Color Imaging, UniNet and UI Supplies named as defendants.
Canon Inc. has successfully extended its patent infringement complaint began in January 2010 against new defendants Color Imaging, Inc., UniNet Imaging, Inc. and subsidiary UI Supplies, Inc. as of 15 September 2011.
The complaint has been made in relation to US Patent No. 7,647,012 (thusly summarised as the 012 patent) entitled “Sealing Member, Toner Accommodating Container and Image Forming Apparatus” and describes the toner bottle products for use with Canon imageRUNNER copiers.
Canon are claiming that “the Accused Toner Bottle Products are substantially identical in structure” despite “defendants market[ing] their toner bottle products as purported alternatives to genuine toner bottle products manufactured […] and sold under the Canon name”.
The bottles are for use with several in the Canon imageRUNNER line, including the imageRUNNER 2230/2270/2830/2870/3025/3035/3225/3230/3235/3245/3530/3570/4570; 5070/5570/5570N/6570/6570N; 7086/7090/7095/7105; 5050/5055/5065/5075; imageRUNNER ADVANCE C5045/C5051; and C5030/C5035.
The complaint was originally filed against Densigraphix Inc. on 12 January 2010, and resulted in a Stipulation, Consent Judgement and Permanent Injunction three months later, as well as Copylite Products Corp., and Polek Inc on 29 June 2010 and also resulted in a Stipulation, Consent Order and Permanent Injunction entered on 16 September 2010.
Color Imaging have acknowledged the suit with The Recycler although were unable to
comment, and Uninet declined to comment.
