Shanghai Angel, Tatrix and others found in violation of section 337 after failing to respond to the Complaint and Notice of Investigation.
The United States International Trade Commission (USITC)
has granted HP a general exclusion order against several aftermarket companies following their failure to respond to a Complaint and Notice of Investigation.
HP, as complainant, named Mipo International, Ltd.; Mextec Group Inc.; Shanghai Angel Printer Supplies Co., Ltd.; Shenzhen Print Media Co., Ltd.; Zhuhai National Resources & Jingjie Imaging Products Co., Ltd; Tatrix International; and Ourway Image Co. Ltd as respondents in the original complaint on 3 August 2010 alleging a violation of section 337 “in the importation, and sale for importation, and sale within the United States after importation of certain inkjet ink supplies and components thereof by reason of infringement of certain claims of U.S. Patent Nos. 6,959,985 and 7,104,630”.
Mipo, Mextec and Shenzhen were removed from the investigation following “either a settlement agreement with HP or because HP withdrew its allegations against them”.
The remaining respondents Shanghai Angel, Zhuhai National, Tatrix and Ourway have each “failed to answer the Complaint and Notice of Investigation”, with HP “requesting a recommendation for a general exclusion order”.
The Commission thusly “determined that the appropriate form of relief is a GEO under 19 U.S.C. § 1337(d)(2), prohibiting the unlicensed entry of inkjet cartridges and components”.
