Clover and Canon engage on settlement agreement

Canon and Clover have filed a joint motion to extend a response deadline while working on an “agreement-in-principle” which will include a Joint Motion to Terminate the investigation.

Clover respondents and Canon have recently filed a joint motion to the US International Trade Commission (USITC) to extend its deadline of response following an “agreement-in-principle” which will include a Joint Motion to Terminate the investigation, reports Actionable Intelligence.

Clover and Canon have filed a joint motion to extend a response deadline following a recent “agreement-in-principle to resolve this investigation […] which resolution shall include a Joint Motion to Terminate this Investigation as to the Clover and Clover-Customer Respondents pursuant to a Consent Order”.

Details of the resolution are said to be in the process of being finalised, and a joint motion to terminate the investigation is hoped to be filed by 30 August.

The case, which began on 23 January 2012, was launched against 32 aftermarket companies, including a number of Clover respondents, accusing them of patent infringement and was described by the aftermarket news site as a “reman nightmare” realised.

Clover has consistently denied allegations of patent infringement, while a number of companies including Atman, Inc., Do It Wiser, and OnlineTechStores.com among others settled in short succession after March 2012.
