Printing services company seeks jury trial against OEM on grounds of patent infringement regarding a number of Xerox devices.
RR Donnelley, a global printing supplies company, 
has accused Xerox of infringing on four patents covering colour printing technology and will sue the OEM in Illinois federal court.
The complaint was launched on 7 August and concerns the patents 6,205,452; 6,327,599; 6,844,940; and 7,278,094, which are said to be implemented in infringing software including “the Xerox FreeFlow VI suite […] and/or the Xerox XMPie suite of software tools”.
The software tools are implemented or compatible with a number of Xerox’s commercial colour printers including the iGen3, iGen4, and the DocuColor 5000, 7000 and 800 models, which have each been individually named in RR Donnelley’s complaint.
RR Donnelley state in the complaint that Xerox “has infringed, induced infringement of, and/or contributorily infringed […] one or more claims” of the ‘452, ‘599, ‘940 and ‘094 patents and has demanded a jury trial on all issues.
Included in RR Donnelley’s stated prayer for relief, which includes judgements that Xerox has infringed each patent, is “a judgement and order requiring Xerox to pay RR Donnelley any and all damages” in conjunction with “increasing the amount of actual damages by this Court, up to a trebled amount, because of the wilful and deliberate nature of Xerox’s acts of infringement”.
According to the Public Access to Court Electronic Records (PACER), Xerox has yet to respond.
