Canon concludes IP lawsuit with Provantage LLC

USDCSDNYProvantage has agreed to an injunction from making, using, selling and offering for sale infringing cartridges, as well as importing them into the USA.

The OEM reported on the conclusion of its lawsuit with Provantage LLC, one of the defendants originally named in the large IP case begun in February.

The case originally named the company as one of 18 defendants, but when the OEM lodged a complaint with the United States International Trade Commission earlier this month, Provantage, along with MSE, were the only two original defendants not named.

Canon revealed that the “successful conclusion” of its case against Provantage had taken place in the US District Court for the Southern District of New York, with Provantage agreeing to a Consent Judgement and Permanent Injunction, prohibiting it from “making, using, selling and offering for sale in the US, and from importing into the US, the toner cartridges and photosensitive drum units” Canon had accused it of infringing.

These patents include US patent numbers 8,135,304, 8,280,278, 8,369,744, 8,532,533, 8,565,640, and 8,630,564, the original patents that Canon first mentioned in the case in February, and which are “sold for use in more than 50 models of Canon and HP laser beam printers”.
