The remanufacturer is “pleased to announce” the case’s resolution, and will “continue to offer” cartridges “that comply with the OEM’s terms”.
ILG, which became part of the Turbon Group in late 2013, revealed earlier this week that it has “entered into a settlement agreement” with Canon concerning its naming in the OEM’s IP cases in the District Court for the Southern District of New York, which began in February 2014, and the USITC (United States International Trade Commission), which took up its own case in May 2014.
The company added further comment to the settlement announcement, stating that it is “pleased to confirm that following the resolution of its dispute with Canon, ILG and Turbon USA Inc. will continue to offer its full line of remanufactured laser toner cartridges that will comply with the terms of the consent order and injunction”.
ILG also stated: “Canon’s International Trade Commission investigation and patent lawsuit have been resolved by mutual agreement of International Laser Group, Turbon USA Inc. and Canon. Our loyal customers can continue to purchase these products with the assurance that Canon’s intellectual property claims have been resolved. International Laser Group, Turbon USA and all Turbon companies worldwide respect the intellectual property rights of others.”
The settlement between ILG and Canon regards the alleged infringement of US patents 8,280,278, 8,433,219, 8,437,669, 8,494,411, 8,630,564, 8,676,090, 8,682,215, and 8,688,008; and ILG added that “to resolve the matters” it will “stipulate to a Consent Order” from the USITC, as well as a “Consent Judgement and Permanent Injunction” from the Southern District of New York, which will allow it to “be dismissed from both cases”.
The patents concern the OEM’s ‘dongle-gear’ within toner cartridges – specifically the HP P2035, 2055 and P3015 – and Canon noted at the start of the case that the cartridges “are sold for use in more than 50 models of Canon and HP laser beam printers”. Other companies that have settled in the case since it began include Acecom, Do It Wiser and Green Project; ACM Technologies, Grand Image LLC, OnlineTechStores, Nectron, Provantage, Printronic and LD Products.
