Latest settlement announced in Canon IP case

Canon’s press release stated that it had settled with Printronic Corporation in the US District Court for the Southern District of New York. The case related to infringement of the OEM’s “dongle-gear” within toner cartridges – specifically the HP P2035, 2055 and P3015 – which are sold “for use in more than 50 models of Canon and HP laser beam printers”. The company had previously settled in the USITC case in June 2014.

The US District Court case against a number of aftermarket representatives began in February 2014, while a case at the United States International Trade Commission (USITC) began in May 2014 and is moving towards a General Exclusion Order (GEO), with some defendants still remaining. The press release specified that the Printronic case concerned cartridges and photosensitive drums, and the US patents 5,903,803 and 6,128,454.

As part of the settlement, Printronic has stipulated to a consent judgement and permanent injunction, which prohibits its from “making, using, selling and offering for sale in the US, and from importing into the US, the toner cartridges and photosensitive drums that Canon accused of infringement”.

Canon in turn presented its usual settlement statement: “Throughout the development, sales and marketing process, Canon respects the intellectual property of other companies and individuals and expects others to similarly respect Canon’s intellectual property rights. Canon remains committed to pursuing legal enforcement against those who do not respect Canon’s intellectual property.”

Other companies that have settled in the cases since they began include Acecom, Do It Wiser and Green Project; ACM Technologies, Grand Image LLC, ILG, LD Products, OnlineTechStores, Nectron, Provantage, and Supply Guys.
