Canon settles OPC case in Germany

The District Court of Düsseldorf has banned Mr. Thomas Zenkel “from using, selling and offering the infringing photosensitive drum units in Germany”.

Zenkel sold toner cartridges with the drum units for various models of Canon and HP German laser printers, and was found to be infringing Canon’s European patent 2 087 407. Other cases based on this patent are still pending across Europe, while this particular case began in July 2014.

The court decreed in its June 2015 ruling that Zenkel, who operated under ‘tintenalarm.de’, is to recall the products from the distribution channel, while a “declaratory decision” on liability damages is also included. Other cases based on this patent are still pending.
