Xerox ordered to settle in pensions case

The OEM must pay $4.9 million (€4.6 million) for lawyer fees and compensation to employees.

BNA reported that the lawsuit was brought against the company 16 years ago when employees accused Xerox of “miscalculating their pension benefits by using a ‘phantom account’ to offset an earlier lump sum payment”. The hearing took place at the US District Court for the Western District of New York with Judge David G. Larimer presiding, who granted the workers request “for attorney fees” but not for the initial amount demanded, which was $7.9 million (€7.5 million), instead he halved the amount.

However, Larimer did allow the use of “outdated billing rates” because the current ones were “unreasonably high”, and opted for those from 2011, as well as applying a 50 percent reduction of fees for the work of a lawyer who died during the case. The long-running case has been taken to the US Court of Appeals and the US Supreme Court several times, and Xerox has already paid $4 million (€3.8 million) to its employees from the outcome of trials and appeal courts.
