Aster Graphics files suit against Static Control

Aster filed a complaint for declaratory relief of patent non-infringement against Static Control on 7 July in the US District Court Central District of California.

The patents in question are listed as U.S. Patent Nos. 9,671,742 B2 (the “’742 patent”) and 9,599,949 B2 (the “’949 patent”) originally owned by Zhuhai Seine Technology Co., Ltd.

Aster Graphics Inc filed the lawsuit after Static Control sent a letter 29 June 2017 identifying two patents, 742 and 949 and alleged that Aster had infringed the patents and also demanded that the company “cease all allegedly infringing activity and confirm compliance with Static’s demands”.

Static then advised Aster that if it did not receive a satisfactory response by 10 July it was prepared to take action against the company without further notice and reserved the right to seek injunctive relief and damages.

Because of these actions there is controversy between the two companies as to whether Aster’s laser toner cartridge products infringe the 742 and 949 patents and Aster is seeking a declaratory judgement of non-infringement and demands a trial by jury on all issues.
