Canon obtain preliminary injunction for patent infringement

The move comes following another alleged infringement of the company’s European patents.

Canon Inc. have been granted a preliminary injunction against JT Company UG (haftungsbeschränkt) and its managing director, Jurij Tkaciov.

The injunction, containing inter alia injunctive relief, granted by the District Court, Düsseldorf, is based on the infringement of the German portion of Canon’s European patent EP 2 087 407, which relates to a drum unit and a process cartridge. The act in question that has led Canon to seek this measure was the offer and distribution of laser toner cartridges, comprising a drum unit, through Amazon.de, using the ASINs (Amazon Standard Identification Numbers) B071RGYGCV and B072B5KTZ7. Those cartridges replace the cartridge models HP CE505X and HP CF226A, which are compatible with HP laser beam printers.

The preliminary injunction is not yet final, and the defendants have the option to file an objection against it. Canon will be able to enforce the decision after the injunction has been served on the vendors.

The granting of the preliminary injunction is the latest in a string of similar victories for Canon this year. In June, it was granted another PI against M&S Vertrieb Service OHG, again by the District Court, Düsseldorf, for infringement of another of their European patents. Moreover, in August, Canon obtained three preliminary injunctions in a single week, against Printperfect Ltd, Moreinks Limited, and Coemedia GmbH, all for infringements of German portions of Canon’s European patents.
