Today the OEM announced that the patent dispute with Printperfect Ltd. has been resolved with the signing of a settlement agreement.
Earlier this year, The Recycler reported on the preliminary injunctions Canon had been granted in Germany against Printperfect Ltd and Moreinks Limited.
This injunction was based on the alleged infringement of the German part of Canon’s EP 2 087 407 patent, which covers a drum unit and a process cartridge. The preliminary conjunction was to prevent Printperfect Ltd from offering or distributing laser toner cartridges with a drum unit and certain coupling member e.g. via amazon.de under the ASINs (=Amazon Standard Identification Number) B01NASKWVM and 5452009043. The mentioned cartridges can replace the cartridge models HP CF226X and HP CF287A compatible with HP laser beam printers.
At the time, Canon revealed that Printperfect Ltd and its managing directors had accepted the preliminary injunction as “a final and binding solution between the parties.”
Now, the OEM has issued a statement revealing that the patent dispute between the two companies has been settled with the signing of a settlement agreement. As well as accepting the preliminary injunction, when it comes to the English portion of the patent, Printperfect Ltd “has agreed to refrain from offering, putting into circulation and/or importing and/or owning laser toner cartridges comprising” the contested drum unit and coupling member which were “for use in various models of HP and/or Canon laser beam printers in Great Britan.”
