HP Files Unfair Competition Lawsuit against Pelikan

HP’s German subsidiary, Hewlett-Packard GmbH, has filed a second lawsuit against Pelikan Hardcopy Deutschland GmbH, in which it alleges misleading advertising.

The first lawsuit, alleging patent infringement, seeks to prevent Pelikan from selling colour inkjet print cartridges that infringe HP patents.

This new lawsuit, filed in Cologne District Court, alleges unfair competition violations by Pelikan and relates to the packaging of Pelikan-branded colour inkjet print cartridges sold as H06 and H08. The packaging for these cartridges describes the cartridges as remanufactured. Tests by HP indicate, however, that certain of the products sold in this packaging are apparently new, as opposed to remanufactured, products.

 
Recycler has contacted Pelikan and is awaiting their comment on this development.
