The OEM seeks to find 17 companies found in default for failing to respond or provide adequate response to Canon’s complaint.
As of 13 August, Canon has sought to have 17 companies out of 32 in its cartridge patent investigation found in default by the USITC on the grounds of failure to respond or provide adequate response to the complaint.
The companies listed are Shanghai Orink Infotech International Co., Ltd; Orink Infotech Intemational Co., Ltd; Zhuhai Rich Imaging Technology Co., Ltd.; Standard Image Co., Ltd.; Zhuhai National Resources & Jingjie Imaging Products Co., Ltd.; Standard Image USA, Inc.; Printronic; Nukote, Inc.; Do It Wiser LLC d/b/a Image Toner; E-Max Group, Inc. d/b/a Databazaar.com; IJSS Inc.; Imaging Resources LLC; Ink Technologies Printer Supplies, LLC; OnlineTechStores.com, Inc.; SupplyBuy.com, Inc.; Zinyaw LLC.; and Acecom Inc.
The Motion for Initial Determination Finding Certain Respondents in Default notes that “Commission Rule 210.16 provides that a respondent “shall be found in default if it fails to respond to the complaint and notice of investigation […] and fails to show cause why it should not be found in default”.
Canon states that “none of the other defaulting Respondents has responded to the order to show cause or does anything to explain or cure its failure to answer the complaint and notice of investigation or respond to Canon’s discovery requests”.
Particular attention is shown to OnlineTechStores and Acecom, noting that OnlineTechStores has specifically stated that it “did not formally answer to […] Canon’s ITC complaint”. Acecom is noted to have asked to be treated “as a Motion for Default”.
Clover in currently engaging on a settlement agreement with the OEM, having recently filed a joint motion with Canon to extend a response deadline while working on an “agreement-in-principle” which is said to include a Joint Motion to Terminate this Investigation.
