Terms of settlement confidential as US supplier consents to a permanent injunction of dealing in toner cartridges accused of infringement.
US imaging supplier Green Project, Inc. has settled with Canon regarding the company’s alleged patent infringement of Canon’s US patents 5,903,803 and 6,128,454, listed as “process cartridge, electrophotographic image forming apparatus, driving force transmission part, and electrophotographic photosensitive drum”.
The settlement was reached between the two companies in the International Trade Commission and US District Court for the Southern District of New York, and sees Green Project stipulate to a Consent Order and Consent Judgment and Permanent Injunction that will prohibit the US supplier from “making, using, selling and offering for sale in the US, and from importing into the US, the toner cartridges that Canon accused of infringement”.
The terms of the settlement are confidential.
Green Project stated that it is “pleased to be able to continue lawfully meeting all of its customers’ needs for environmentally friendly high quality products with its complete line of remanufactured inkjet and toner cartridges. Green Project is unfailingly committed to providing the highest quality genuine remanufactured products and customer service to its customers.”
A number of companies have settled with Canon in the ubiquitous case including Clover.
