The OEM has added Seine Holland to the same patent infringement suit as Aster Holland.
Canon announced that Seine Holland B.V. had been added to its toner cartridge patent infringement suit in the Netherlands, which began against Aster Technology Holland B.V. on 28 April and which concerns Canon cartridges used in HP machines.
The suit was filed in the District Court of The Hague against Seine Holland, and refers to the “importation, offer and sale of certain toner cartridges for use in various models of Hewlett-Packard laser beam printers”, with the OEM seeking “injunctive relief and damages” against the company. The case revolves around the supposed infringement of European patent 2 087 407, as in the Aster lawsuit.
Canon stated: “Throughout the development, sales and marketing process, Canon respects the intellectual property rights of other companies and individuals and expects others to do the same. Canon remains committed to taking legal action against anyone who does not respect Canon’s intellectual property rights.”
Canon is currently engaged in an IP case in the USA against 18 aftermarket companies, and the cases in the Netherlands follow Samsung’s court battle with toner dealers in the country, against three of which it saw victory in January earlier this year.
