The OEM has had its claim that Dutch office supplies shop 123inkt.nl should not have been granted a patent for a chip used in certain of its inkjet cartridges overturned.
123inkt said that the court had ruled that HP’s European patent “was invalid because it was not novel”, meaning the Dutch group can continue to sell the cartridges.
It further reported that a second IP case taken up by HP in December 2014 has likewise been overturned.
The retailer was also successful in countering an attempt by Samsung to ban sales of its own-brand toner cartidges for Samsung printers in April of this year.
Gerben Kreuning, Director of 123inkt, said: “For all printers we offer the original brand and in most cases also our own brand as an alternative.
“HP has pulled out all the stops with an army of lawyers to limit the choice for consumers to only the expensive HP-branded products. This feels like a double win, because I also see the settlement as a victory for us.”
